John Conroy, QC Canada’s leader in Charter litigation on medical cannabis explains to “The Lawyers Weekly” reasons for challenging the Marijuana for Medical Purposes Regulations (MMPR).

The eventual outcome from Allard (2015) determined that the right to “grow your own” was a protected right for medical authorized users of cannabis, and the MMPR framework unjustifiably infringed on that right; It forced them to purchase only from government suppliers, and arguments presented by Mr. Conroy and Kirk Tousaw discussed here, resulted in new regulations (the ACMPR, 2016) permitting authorized medical users to grow their own cannabis in addition to purchasing from licensed producers.
